Terms and Conditions

Payment Terms: To secure the items, the buyer must provide a 50% deposit of the total  price, and the remaining balance is due 24 hours before the scheduled pickup. It's important to note that cancelled orders will incur a restocking fee equal to 10% of the total price.

Title and Ownership: Title to the container home will transfer to the buyer upon pickup, provided that all payments have been made in full. The buyer is responsible for any applicable taxes or fees associated with the transfer of ownership. 

Delivery and Installation: The buyer must ensure that the delivery location is accessible and can accommodate the container home/Pods. The seller will not be responsible for any damages incurred during pickup, delivery and installation. 

Warranties and Guarantees: The frame comes with a 3-year structural guarantee, and internal fixtures are covered by a 12-month warranty. This warranty does not cover damages caused by improper installation, water proofing, use, or maintenance of the container home.      

Dispute Resolution: Any disputes between the buyer and seller will be resolved through arbitration in accordance with the Queensland Civil and Administrative Tribunal and arbitration rules. The arbitration will be conducted in Brisbane, Australia and the decision of the arbitrator will be final and binding on both parties.

Governing  Law: This agreement is governed by the laws of Queensland, Australia. Any legal action arising from this agreement must be brought in the courts of Brisbane, and both parties agree to submit to the jurisdiction of these courts. 

Limitation of Liability: The seller will not be liable for any damages or losses incurred by the buyer, except in cases of wilful misconduct or gross negligence. The seller's liability will be limited to the purchase price of   the container home. 

 Severability: If any provision of this agreement is found to be   invalid or unenforceable, the remaining provisions will remain in effect.

Entire Terms and Conditions: These terms and conditions represent the entire agreement between the buyer and seller and supersede any prior agreements or understandings. No modifications or amendments to these terms and conditions will be valid unless made in writing by the seller.
